Wills Probate & Administration of Estates

 

 

Your Will is a vitally important document. It should be reviewed periodically so that it is up to date and accurately reflects your wishes. Our Probate Team will ensure that your Will is properly made and executed, that it meets with your requirements while minimising adverse tax implications. The transfer of assets and property (including a farm or business) from generation to generation requires careful planning and consideration. We have many years' experience of drafting Wills and advising in Estate Planning.

 

If you are entrusted to administer the estate of a deceased relative either as executor (where there is a Will) or as administrator (where there is no Will) it can be a traumatic experience at a difficult time in one's life. We will guide you through the process giving you the best advice possible with compassion and expertise. We have the necessary experience and expertise to enable us to handle estates effectively involving complex family situations, estates where there are properties both in Ireland and abroad and Estates with complex tax and financial issues

We have many years experience in the drafting of Wills and Trusts. Advance planning and careful crafting of Wills and Trusts is essential to avoid legal and tax problems in later years.

The analysis of the potential future legal and tax consequences of inadequately drafted Wills and Trusts is an area in which we are particularly experienced, and the firm has an expertise in the review and where necessary re-drafting of such documents to avoid or minimise future liabilities or misunderstandings.

 

We can provide all necessary legal services to Legal Personal Representatives and/or Trustees.

We deal with all aspects of the Administration of a deceased’s estate from preparing and filing the Inland Revenue Affidavit, preparing and filing the papers necessary to obtain a Grant of Representation, dealing with all taxes arising both pre and post death, through to the final distribution / vesting the assets of the estate in the beneficiaries and the preparation of estate accounts.

 

We can also advise where appropriate on how to vary the provisions of a will or intestacy by use of Deeds of Disclaimers and/or Deeds of Family Arrangement.

Further, we can offer independent legal advice to beneficiaries and / or the surviving legal spouse who are unsure of their legal position.

 

As we have developed highly efficient systems to streamline the necessary processes, we can typically obtain a Grant of Representation within approximately three months and complete the administration (provided there is no litigation arising) within approximately six months.
